Advance Fee Deposit Agreement and Acknowledgment
1. Non-Legal Advocacy Services
I understand that I am purchasing non-legal special education advocacy services from Montgomery Law Group, PLLC.
These are not lawyer services. They do not include legal advice, legal analysis, legal opinions, or legal representation. No attorney is being retained through this purchase.
Purchasing or using these services does not create an attorney-client relationship with Montgomery Law Group, PLLC, Dr. Mary Montgomery, the assigned advocate, or any attorney associated with Montgomery Law Group, PLLC. Communications concerning these advocacy services may not be protected by attorney-client privilege.
An advocate may provide educational guidance, review educational records, help prepare for school meetings, participate in meetings, and assist with communications concerning a student’s educational program.
An advocate will not act as my lawyer, give me legal advice, file legal claims, or represent me in a due process hearing, administrative proceeding, or court case.
Legal services require a separate written legal-services agreement signed by Montgomery Law Group, PLLC and the client.
2. What I Am Purchasing
I am purchasing an Advance Fee Deposit of $2,500 for eleven (11) hours of non-legal advocacy time.
The deposit consists of ten hours charged at $250 per hour, plus one additional bonus hour provided at no charge. The reduced $250 hourly rate, in place of the standard $275 rate, is available because the fee is paid in advance.
3. Non-Refundable Advance Fee, Earned on Receipt
I understand that this is a non-refundable advance fee, earned by Montgomery Law Group, PLLC upon receipt.
I understand this means the fee is not held on my behalf and is not refundable if I decide not to use the hours, except where otherwise required by law.
4. Expiration of Hours
My hours are valid for twelve (12) months from the date of purchase. Hours not used within that period expire and are not refunded or extended.
5. How the Hours May Be Used
Hours may be used as the case requires, including records and document review, correspondence and letters, telephone calls, preparation, attendance at school meetings by video in all fifty states or in person in South Florida subject to availability, records requests, independent evaluation requests, and written follow-up to the district recording what was agreed.
6. Additional Time
Once all eleven hours are used, further advocacy time is billed at $275 per hour, or I may purchase another advance fee package.
7. Payment Authorization
I authorize Montgomery Law Group, PLLC to charge my selected payment method $2,500 for the Advance Fee Deposit.
8. No Guaranteed Outcome
I understand that Montgomery Law Group, PLLC and the advocate cannot promise or guarantee any particular educational, administrative, or legal result.
Customer Acknowledgment
By checking the acknowledgment box and completing my purchase, I confirm that:
- I have read and agree to this Advance Fee Deposit Agreement.
- I am purchasing non-legal advocacy services, not lawyer services.
- I am not receiving legal advice or legal representation.
- No attorney-client relationship is created.
- I am paying $2,500 for eleven hours of advocacy time.
- The fee is non-refundable and earned on receipt.
- My hours expire twelve months from the date of purchase.
